This Morning’s Lies

It's increasingly difficult to keep up with all of the lies being touted on Twitter and elsewhere. These are just a few from this morning.

IMPORTANT POINT REPORTERS ARE MISSING IN PA SUIT: The Supreme Court only denied emergency injunction relief. In the order, it did NOT deny cert. @MikKellyPA’s suit is still pending before the U.S. Supreme Court.

Lie. Once the Supreme Court denied the injunction, there was nothing remaining before it. Kelly may still file a writ of certiorari, but as of now he has not done so.

Some Twitter person:

BREAKING: The Supreme Court ruled 6-3 to take up the lawsuit from Texas, which now has a total of 10 states. TN has just joined the suit against GA, PA, WI and MI.

Lie. There has been no such ruling. All the court has done (without vote) is ask for briefing. TN has not joined the suit. They are merely filing a brief in support.

We will be INTERVENING in the Texas (plus many other states) case. This is the big one. Our Country needs a victory!

This really isn’t a lie, but it is misleading. Once an individual intervenes (becomes a party) in a suit between the states, the Supreme Court loses its original jurisdiction over the matter. If Trump were to actually intervene, the case would be caput.

I will have more about the Texas case later and what “original jurisdiction” in the Supreme Court really means. [Written December 9, 2020]
