Attorney L. Linn Wood lost his appeal to the 11th Circuit Court of appeals in his Georgia case this morning. The three judge panel (appointed by Bush, Obama and Trump) discussed many of the things we’ve talked about lately. This is what they said. You are the wrong plaintiff (standing). Even if you were the right plaintiff, you filed in the wrong court (jurisdiction), and even if you were in the right court, you waited too long to bring the case (mootness). The language of the ruling was brutal. As one seasoned appellate attorney put it: “I would hide in a cave with only a parrot for a friend if I lost cases like this.” [Written December 5, 2020]
